Hi, Monday June 24, 2024 the Justice of the Peace in Houston, Texas ruled in favor of the debt collector, and I'm interested in appealing this civil trial decision. I heard you mention I will be starting anew with the court I'm leveling up to, so will I be able to request full validation from the debt collector? This debt collector/associate attorney handed me their business card, and it states they are from Cleveland, Ohio... Can they practice in Texas? Florida… Portfolio recovery is suing me on Account Stated and unjust enrichment. I requested a copy of OALD. Original account level documents. They have not sent it to me within 30 days. According to the lawsuit between CFPB they have to give me these documents upon request. Can I put this in my affirmative defenses and get it dismissed. I plan ask for a motion to dismiss. The stipulation is so clear on how they have to treat the consumer. Do I have a chance or should I take another route.

Sort of related - A couple decades ago, my wife and I attempted to finance through and add for a percentage we could deal with. Months later, when the representative came over, it was suddenly 4 percent higher. We only noticed because we actually read the document. We told the rep what we had agreed to and was never told of an increase. He, who had flown out at his company's expense, simply had to leave. He had no power to replace the original rate. When I called his firm, they said, 'Oh, that was the rate several months ago' to which I said, well, that's the rate we saw in the add and your firm never mentioned a change. I'm really hoping the reps airfare was first class. But directly to your point, and is evidenced even by the entertainment courts like 'People's Court' or 'Judge Judy', What's in writing is what counts. Always.

Yes I just got one the other day from a gym. I opened while I was out and I forgot about it until about a week later. Then I could not find it in my email because I forgot the name of the collection agency. I had to search for it and I will advise them to no longer use electronic communication. I believe they do it in hopes of one not checking email, which I will have to do more often.

I have a question. When you file a complaint that you think you have too much info already. Then You file a motion for default. Can you file a motion when the judge grants part and denies part based upon failure to state a claim? Thanks.

Do you do any MA claims? Equifax is reporting the wrong date of birth, old addresses, employer, and other aliases on my credit report. I called them on numerous occasions to update my date of birth, report employment information and to clean up my personal information. They’ve refused to do it. I filed a claim with CFPB and uploaded a MA liquor ID with the correct d.o.b., address. They closed that case and were requesting that I mail them social security card and other supporting documents because they won’t accept a liquor ID as a valid ID. I the filed a dispute on CFPB after that stating that out of the three credit bureaus, they’re the only one reporting it wrong. I also mentioned that since all information should be reported with complete accuracy across all bureaus, they need to update information and remove any negative file associated with the wrong d.o.b. Still nothing. And because of the wrong dob, I cannot sign up for credit monitoring with them because information aren’t matching. Is this worth suing? And can you help?

I asked the attorney representing the plaintiff for the purchaee agreement and he sent an email stating he does not have to provide me with proof. I asled for contract. He said he doesn't have to provide that as well. How can i prove they can sue me for the debt?? I feel like Im being rail roaded.

Don't they buy bad debt in bulk? If so, can't they just say your account was included in this purchase I got an email from my original creditor that states my account was sold to xyz collection and thet will be servicing my account. Can't they produce that same email?

I’m sorry, but that is inaccurate, their obligation to mark your account with the notice of dispute within 30 days is under the FCRA, and if they failed to insert said notice, you may then sue after 30 days

I just won my motion against the creditor and it depends on the situation. But if you don't go through the credit reporting agencies, and sue the creditor directly , you do have a private right of action through 1681n amendments done in 1996. Nelson v Chase.

Ohhhhh so basically if the original company sold the debt to a collection agency then chances are high the information isn’t even correct. That’s good to know

The most concerning and interesting portion of my situation is how many people- my family members- advocated bankruptcy. There is nothing wrong if that is what needs to be done.. but to suggest it before even asking or offering to help. That is very concerning for the overall economic forecast. It has ramifications and impact far beyond the statement, just claim bankruptcy. That’s 7 years.. that’s others eating my debt. That’s no accountability - and that’s similar to what happened on the bank run on 1929. Not thinking of the ramifications that would throw a country into poverty, a dust bowl, desperation, and unemployment that took decades to overcome. My apologies for this interruption - I appreciated how you began your lecture. What happens if people non-chalantly give others advice that has not been fully considered. Watch too big to fail.. it will happen again with all of the short memories of the bankers and consumers. Thank you sir for asking the question early on.

I’m having a situation where data was once present for payment history, balance history etc prior to a charge off… Then After the charge off date every and all pieces of prior information and data was wiped from the account and only a copy and pasted balance amount higher than the original is inserted in the high credit amount and in the past due amount each and every month till today 3yrs later.

I knew it- that’s why my bank sold my account. I had 4 accounts with them.. now that’s just not a good business model. Gratitude.

Great inoformation. Im being sued now by midland credit. Im in florida but i already hired a lawyer. I have yet to be served any papers. After watching several of your videos i can now understand how you can win a case against them. With your knowledge i think i could of gone to cort myself and had a good argument to win. My God. My boyfriend's debt collector keeps calling me and leaving messages for my boyfriend so they are now harassing me about it. I have ABSOLUTELY nothing to do with this loan but they are bothering me in attempts to get him to pay. I'm absolutely sick of this. I would like to sue them into oblivion so they will leave me the Hell alone.

Just finished a charge off case with a lawyer who sent me random mail advertising his services. This man was phenomenal! Got the debt dismissed with prejudice like it never existed on my credit file!!

I go to court july 10th. Its not for being irresponsible with credit card debt. It is for a 6,000$ hospital bill. I was working 90 hours a week and passed out from exhaustion. I told the doctors not to touch me and they said i was "being non compliant". I knew i needed rest. But i was taken there anyways. Unfortunately i answered my door being served. I wouldnt have but i work in an environment where i always have to call the cops so i thought it was for work. Ugh. Its "collection agency bureau " i didnt see a lawyer on my paperwork. And the agent i talked to asked for a settle amount i said 2037 by july3 or pay 410 a month for 13 months. I eat ramen noodles every day i cant afford to live. This is very disheartening. I sold my furniture will sleep on the floor and I went to pay 2037 yesterday.And i guess hes on vacation and his supervisor said they would never settle for less than 4800. One of the first sentences in my service paperwork says "you will lose this lawsuit". I feel very sad about this medical debt. It seemed very unfair in the first place. I dont remember some of the charges after i got an itemized bill but the hospital said it was correct. Im currently trying to find all my bills and debts to file bankruptcy. Which sucks because my credit is great i always pay on time. Just being a medical bill i could never be able to pay. Im going to show in court. Am i doing the right things?
